Summary: Welcome to the game services provided by PAPILLON ENTERTAINMENT LIMITED (hereinafter referred to as "PAPILLON")!
This "PAPILLON License and Service Agreement" (hereinafter referred to as "this Agreement") is jointly entered into by you and the PAPILLON service provider, and this Agreement is legally binding. Please carefully read and fully understand the content of each clause, especially the clauses that exempt or limit PAPILLON's liability (hereinafter referred to as "exemption clauses"), clauses that limit user rights (hereinafter referred to as "limitation clauses"), clauses on dispute resolution and jurisdiction, as well as separate agreements for specific services. The aforementioned exemption, limitation, dispute resolution, and jurisdiction clauses may be highlighted in bold, color-coded, or other reasonable ways to draw your attention, including but not limited to clauses such as Articles 2, 3, 4, 6, and 9 of this Agreement. Your acceptance of these clauses may lead to passive inconvenience and losses in specific situations. Please read these clauses again before agreeing to this Agreement or using PAPILLON services.
Unless you have read and accepted all the terms of this Agreement, you are not authorized to use PAPILLON services. If you have any comments or suggestions about this Agreement or PAPILLON services, you can contact PAPILLON's customer service department, and we will provide you with the necessary assistance. By clicking "Agree," "Accept," or "Next," or by registering and using PAPILLON services, you are deemed to have read and agreed to sign this Agreement.
If you are under 18 years of age, please read this Agreement with the accompaniment of your legal guardian and pay special attention to the terms for the use of minors. If you are a legal guardian of a minor, we hope to establish reasonable entertainment time for your child and cultivate healthy gaming habits for them.
1.[Definitions]
1.1 This Agreement: refers to the main body of this Agreement, "PAPILLON Privacy Policy", game rules, and their revised versions. Once the above content is officially published, it becomes an integral part of this Agreement. This Agreement also includes "Essential Terms of Formatted Agreement for Network Game Services".
1.2 Game Rules: refers to the user code of conduct, player rules, game notices, tips, and notifications about PAPILLON issued and revised by the PAPILLON service provider from time to time.
1.3 PAPILLON Service Provider: refers to PAPILLON ENTERTAINMENT LIMITED, which provides you with PAPILLON and its services, referred to as "PAPILLON" in this Agreement.
1.4 PAPILLON: refers to the collective name of the games operated by PAPILLON, including computer client games, web games, HTML5 games (H5 games), mobile terminal games, TV terminal games, and other forms of games; PAPILLON may be provided in software form, in which case PAPILLON also includes the relevant software and documentation.
1.5 PAPILLON Service: refers to various online operational services related to games provided by PAPILLON to you.
1.6 You: also known as "Player" or "User", refers to a natural person authorized to use PAPILLON and its services.
1.7 Game Data: refers to various data recorded by the server during your use of PAPILLON, including but not limited to character data, virtual item data, activity logs, purchase logs, etc.
2.[Game Account]
2.1 If you want to use and enjoy PAPILLON, you need to use your QQ number, WeChat account, or other account recognized by PAPILLON as your game account, and according to the requirements of national laws and regulations, log in to the real-name registration system and complete real-name registration. Your application and use of the QQ number, WeChat account, or other account recognized by PAPILLON should comply with the norms for account registration and use as revised and published by PAPILLON from time to time. When you complete real-name registration, you should provide true, legal, accurate, and valid personal information and other related information about yourself, and you must not use the identity information of others for real-name registration. Otherwise, PAPILLON has the right to take one or more measures as specified in the second paragraph of Article 6.5 of this Agreement and may disclose the result of such measures. Therefore, all consequences arising from this shall be borne by you, and PAPILLON has the right to require you to compensate for all losses caused to PAPILLON as a result.
To meet the real-name registration requirements of laws and regulations and regulatory authorities, when using your QQ or WeChat account as a game account, PAPILLON may verify the real-name authentication status of your QQ wallet payment account associated with the QQ or the WeChat payment account associated with the WeChat account. If Tencent reports that the payment account has been real-name authenticated, you agree that PAPILLON will use the real-name information of the QQ wallet payment account associated with the QQ or the WeChat payment account associated with the WeChat account as your real-name information for logging in to the game account. You also agree that Tencent will provide PAPILLON with your real-name authentication status and age information (used to determine whether you need to be included in the anti-addiction system). If Tencent reports that the payment account has not been real-name authenticated, you should follow PAPILLON's requirements to complete real-name registration. You agree that PAPILLON may submit the real-name information you provided to legal authorities, financial institutions, payment institutions, and relevant organizations authorized to retain your information for verification. You can also choose to complete real-name authentication using your QQ wallet payment account or WeChat payment account associated with your QQ or WeChat account (provided by Tencent), and use the real-name information provided by Tencent to complete PAPILLON's real-name registration.
If you use a third-party account recognized by PAPILLON (hereinafter referred to as a "third-party account") as your game account, you agree that PAPILLON may verify the real-name authentication status of the third-party account's provider. If the provider of the third-party account reports that the third-party account you are using has completed real-name authentication, you do not need to complete real-name registration again. You also agree that the provider of the third-party account may provide your real-name authentication status and age information to PAPILLON (used to determine whether you need to be included in the anti-addiction system). If the provider of the third-party account reports that the third-party account you are using has not completed real-name authentication, or PAPILLON has not verified the real-name authentication status of the third-party account's provider, you should follow PAPILLON's requirements to complete real-name registration. You agree that PAPILLON may submit the real-name information you provided to legal authorities, financial institutions, payment institutions, and relevant organizations authorized to retain your information for verification.
If your game account already meets the real-name requirements in a certain PAPILLON game, you do not need to provide related identity information when registering and logging in to other PAPILLON games using the same game account.
2.2 You further understand and agree that you may not be able to make game recharges or consumptions in guest mode. Moreover, once you uninstall or reinstall PAPILLON, or change your mobile phone, computer, or other terminal device, or if such terminal device is damaged, all game-related data in guest mode may be erased and cannot be queried or recovered. If you incur any loss as a result, it will be borne by you. If you use a third-party account recognized by PAPILLON as your game account for using and enjoying PAPILLON, you should also comply with the agreement and rules of the third-party account. If any issues arise as a result of using the third-party account, such as theft, you should contact the third-party for resolution, and PAPILLON may provide assistance as appropriate.
2.3 You fully understand and agree that PAPILLON will use your real-name registration information (including relevant real-name authentication and age information) in the anti-addiction system in accordance with the requirements of the relevant state. In other words, PAPILLON may determine whether to restrict your game account with anti-addiction measures based on your real-name registration information, including whether you are over 18 years old and whether your submitted identity information is in compliance or has been authenticated.
2.4 You fully understand and agree that PAPILLON has the right to review whether the identity information provided by users during registration is true and valid and must actively take reasonable technical and management measures to ensure the security and effectiveness of user accounts. Users have the obligation to properly safeguard their account and password and use them correctly and securely. If either party fails to fulfill the above obligations and it results in situations such as loss of an account or a stolen account, causing damage to the civil rights of users and others, they shall bear legal responsibility. If you find that someone else has used or stolen your game account and password, or any other unauthorized use, you should immediately notify PAPILLON in the manner required by PAPILLON and inform PAPILLON of the measures that need to be taken. When notifying PAPILLON, you should provide personal and valid identity information consistent with the identity information you registered with. After PAPILLON receives your valid request and verifies your identity, it will take corresponding measures according to your request or based on the specific circumstances (including but not limited to temporarily suspending the login and use of the account, etc.). If PAPILLON takes measures based on your request and causes losses to you and other users, you shall bear them. If you do not provide valid identity information, or if the personal valid identity information you provide does not match the registered identity information, PAPILLON has the right to refuse your request. Any consequences arising from this shall be borne by you.
2.5 PAPILLON has the right to delete or otherwise handle the account, game data, and related information of the account and its account data within three years after the account has not been used to log in to PAPILLON's game services, with prior notice.
2.6 A game account is an identification provided by PAPILLON for you to log in to and use PAPILLON and related services in accordance with this Agreement. Its ownership belongs to PAPILLON. You only have the right to use the game account in accordance with this Agreement, the relevant account usage agreement, and the special rules issued by PAPILLON. You may not provide the game account to others in any way, including but not limited to transferring, renting, or lending it to others for commercial purposes such as live streaming, recording, or power leveling. Otherwise, all legal consequences and responsibilities arising from this shall be borne by you, and PAPILLON has the right to take measures, including but not limited to warnings, restrictions or prohibitions on the use of all or part of the functions of the game account, deletion of the game account and game data, and other related information, and even permanently banning the account. Therefore, all consequences arising from this shall be borne by you.
2.7 In the event that PAPILLON provides a game account cancellation function, if you need to cancel the game account, you can follow the account cancellation instructions provided by the game's official website, or contact PAPILLON customer service at 0755-26162066. Our customer service staff will re-verify your account information and ensure that you meet the relevant conditions for game account cancellation as announced by the game's official website. At the same time, you also agree to the game's official website's game account cancellation agreement and other relevant rules. We also want to remind you that if you cancel your game account, we promise to help you cancel the game account within 15 days, and all game revenue under that game account will be cleared. Therefore, before you cancel your game account, please ensure that you have properly handled the game revenue under that game account or have settled the game revenue under that game account. Once you cancel your game account, if there is still game revenue under that game account (including game revenue that has already been generated during the use of the game and future expected game revenue), PAPILLON has the right to clear all game revenue under that game account, and all consequences arising from this shall be borne by you. The game revenue mentioned above includes but is not limited to: game membership rights, levels; all data related to the growth and upgrade of game characters (including but not limited to experience points, honor points, prestige points, titles, etc.); unused virtual game currency, virtual items, and other virtual items (such as vouchers, gold coins, diamonds, items, etc.); purchased but not yet expired or used value-added services; already generated but not yet consumed game revenue or future expected game revenue, etc.
3.【Collection, Use, and Protection of User Information】
3.1 You agree and authorize PAPILLON to collect your user information for the purpose of fulfilling this agreement. This information includes your real-name registration information, game data under your game account, and other information you provide to PAPILLON during your use of PAPILLON services based on security, user experience optimization, and other considerations. The collection of your user information by PAPILLON will comply with this agreement and relevant laws and regulations.
3.2 You fully understand and agree: PAPILLON or its third-party partners may provide you with various information about PAPILLON, such as activity information and promotional information, through various means such as SMS, phone, and email based on your user information.
3.3 You understand and agree: In order to better provide you with game services, improve the gaming experience, PAPILLON may collect your QQ number, WeChat account, and other accounts recognized by PAPILLON as unique identifiers, nicknames, avatars, friend relationships, and other authorized information, as well as relevant operational information and game information in PAPILLON (including but not limited to your login status, battle information/status, achievement information, etc.) and use it. This information may be displayed to you personally or to other users or friends.
You are aware and agree that if national authorities require PAPILLON to assist in investigating your game account (including real-name identity information) and game-related data (such as recharge, consumption, transaction data, etc.) in accordance with the law, PAPILLON may provide the relevant information to the competent national authorities.
3.4 You should fully respect the personal information of any person, including but not limited to other users, that you can learn, receive, or come into contact with through PAPILLON and related services. You should not collect, copy, store, transmit, or use the personal information of other users in any way. Otherwise, you will be responsible for the consequences arising from it.
3.5 Protecting user information and privacy is a fundamental principle of PAPILLON. Unless otherwise provided in this agreement, PAPILLON's services in collecting, using, and protecting user information will follow the "PAPILLON Privacy Protection Guide" and other protocol regulations. Except as otherwise required by law, if you have agreed or authorized PAPILLON to collect, use, or process your personal information in accordance with the aforementioned agreement or regulations, after you revoke that consent or authorization, it will not affect the collection, use, or processing of personal information that PAPILLON has carried out based on your previous consent or authorization. PAPILLON's actions related to the collection, use, or processing of such personal information will remain effective.
4.【PAPILLON Services】
4.1 Subject to your compliance with this agreement and relevant laws and regulations, PAPILLON grants you a personal, non-transferable, and non-exclusive license to use PAPILLON services. You may only use PAPILLON services for non-commercial purposes, including:
(1) Receiving, downloading, installing, starting, upgrading, logging in, displaying, running, and/or capturing PAPILLON;
(2) Creating game characters, setting nicknames, viewing game rules, user profiles, game match results, creating game rooms, setting game parameters, purchasing and using game items, game equipment, game currency, using chat functions, and social sharing functions in the game;
(3) Using other features supported and allowed by PAPILLON.
4.2 During your use of PAPILLON services, you may not record, live broadcast, or disseminate PAPILLON content to others in any way without PAPILLON's permission, including but not limited to not using any third-party software for online broadcasting or dissemination.
4.3 In the case where PAPILLON is provided in software form, you should also comply with the provisions of Article 5 of this agreement regarding software licenses when using PAPILLON and PAPILLON services.
4.4 All other rights not expressly authorized in this article and other terms of this agreement are reserved by PAPILLON. When exercising these rights, you must obtain written permission from PAPILLON.
4.5 If you violate any provision of this agreement, PAPILLON has the right to take one or more measures as specified in Article 6.5 of this agreement and may announce the results of such actions. Furthermore, PAPILLON may demand compensation for all losses incurred as a result of your breach.
4.6 You fully understand and agree that PAPILLON has the right to take appropriate legal actions against users who violate relevant laws and regulations or the provisions of this agreement and may report relevant information to the authorities, all of which you shall be solely responsible for.
4.7 You fully understand and agree that if your actions lead to any claims, demands, or losses made by third parties due to your violation of this agreement or related service terms, you shall bear sole responsibility. If PAPILLON incurs losses as a result, you shall also compensate for such losses.
4.8 You fully understand and agree: Game equipment, game currency, and other game items are part of PAPILLON services, and PAPILLON allows you to use them in accordance with this agreement. Your purchase and use of game equipment, game currency, and other game items must comply with the requirements of this agreement and the specific rules of the game. Additionally, game equipment, game currency, and other game items may have limitations on their validity period. Even if you do not use them within the specified period, they will automatically expire unless there are circumstances beyond your control or due to reasons attributable to PAPILLON. You fully understand and agree that PAPILLON has the right to make adjustments, updates, or optimizations to game-related content (including but not limited to the design, performance, and related numerical settings of game characters, game equipment, and other game items) to better provide PAPILLON services to users.
4.9 You fully understand and agree: In order to ensure the security of your game account and create a fair, healthy, and safe gaming environment, PAPILLON may, in the process of providing PAPILLON services, use technical means to understand the random access memory of your terminal device and the related programs running simultaneously with PAPILLON. If any unauthorized or harmful programs to the normal operation of PAPILLON services are discovered, PAPILLON may collect all relevant information and take reasonable measures to counteract them.
4.10 You fully understand and agree: To ensure the gaming experience of you and other users, PAPILLON has the right to transfer or clear some past game data stored on PAPILLON servers.
4.11 PAPILLON will take effective measures to protect the legitimate rights and interests of minors during their use of PAPILLON services, in accordance with relevant laws and regulations and the provisions of this agreement. This may include technical measures, prohibiting minors from accessing inappropriate games or game functions, limiting the gaming time of minors, and preventing minors from becoming addicted to the Internet. As part of the game rules, PAPILLON will also publish PAPILLON user guides and warning instructions in appropriate locations, including game content descriptions, correct methods for using games, and methods for preventing harm. All underage users should carefully read and follow these guidelines and instructions under the guidance of their legal guardians. Other players should avoid publishing content that may harm the physical and mental health of minors while using PAPILLON services to jointly create a healthy gaming environment.
4.12 You are aware and agree: In any of the following situations, PAPILLON has the right to include your game account in the corresponding anti-addiction system and take corresponding anti-addiction measures:
(1) The system determines that you are under 18 years of age; or
(2) The real-name identity information you submitted is not in compliance; or
(3) Your real-name verification has not been passed; or
(4) Logging in as a guest; or
(5) Other circumstances required by national laws, regulations, policies, or circumstances in which PAPILLON has a reasonable basis to include in the anti-addiction system.
In addition, to further enhance the accuracy of real-name authentication and prevent minors from using others' identity information, we may enable facial recognition verification for certain games or users or obtain your game account information from third-party platforms and identify and record your gaming behavior based on the minor protection policy to determine whether your gaming behavior conforms to the characteristics of minor gaming behavior. If PAPILLON requires you to undergo facial recognition verification and you fail or refuse, your game account will also be included in the corresponding anti-addiction system, and corresponding anti-addiction measures will be taken. For game accounts included in the corresponding anti-addiction system, we have the right to take one or more of the following measures in accordance with relevant national laws and regulations, policy regulations, other provisions of this agreement, PAPILLON's operation strategy, or reasonable requests from your legal guardians:
(1) Provide your legal guardian with information related to your game account (including login information and recharge flow information), enabling your legal guardian to understand your gaming situation in a timely or synchronized manner;
(2) Limit the spending limit of your game account;
(3) Use technical measures to block certain games or game functions, or limit your gaming time or duration;
(4) Cancel or delete information related to your game account and game data;
(5) Take other reasonable measures requested by your legal guardian or deemed reasonable by PAPILLON to restrict or prohibit your use of PAPILLON;
(6) Relevant measures required by national laws, regulations, or policies.
4.13 PAPILLON offers game services to users as a commercial activity. Users have the right to decide independently whether to pay the corresponding fees for the charging items determined by PAPILLON (including but not limited to purchasing the right to use virtual items in the game and accepting various types of charging items, including additional value-added services). If you do not pay the corresponding fees according to the relevant standards, you will not be able to obtain the corresponding game services. You are aware and agree that changes or adjustments to charging items or charging standards are normal business practices, and you may not claim compensation or compensation due to changes or adjustments to charging items or charging standards. You are aware and agree that using legal currency for game recharging, purchasing or exchanging virtual currency in the game, virtual items, and other virtual items or value-added services is considered purchasing game services, and the virtual currency, virtual items, or other virtual items or value-added services you purchase or exchange cannot be refunded or exchanged for legal currency, except as otherwise provided by mandatory laws.
4.14 In any event, PAPILLON is not liable for any losses you suffer during the use of PAPILLON services due to force majeure. Such force majeure events include but are not limited to national laws, regulations, policies, orders from government authorities, and other government actions or other unpredictable, unavoidable, and insurmountable events such as earthquakes, floods, snowstorms, fires, tsunamis, typhoons, strikes, wars, etc.
4.15 PAPILLON may experience abnormal game data or account data due to game software bugs, version update defects, third-party virus attacks, or other factors. Before the cause of the data anomaly is identified, PAPILLON has the right to temporarily freeze the game account. If the data anomaly is found to be due to non-normal gaming behavior, PAPILLON has the right to restore the game account data to its original state before the anomaly occurred (including recovering data transferred to third parties) without assuming any responsibility. If the data anomaly is due to your illegal or non-compliant behavior as determined by this agreement, PAPILLON has the right to take one or more measures as specified in Article 6.5 of this agreement.
4.16 PAPILLON has not authorized you to obtain game accounts, game items, game equipment, game currency, and other game services from any third party through purchase, gifting, or other means. PAPILLON is not responsible for third-party transactions (third-party transactions refer to your acquisition of game accounts, game items, game equipment, game currency, and other game services from third parties through purchase, gifting, or other means), and does not accept complaints arising from disputes resulting from any third-party transactions.
4.17 You fully understand that: There is an objective situation where different operating systems are not interoperable, and this situation is not caused by PAPILLON. This may lead to difficulties in transferring your recharges and game data from one operating system to another. The risk of recharge loss and game data loss resulting from switching between different systems should be borne by you, and PAPILLON shall not assume any responsibility for this.
4.18 You fully understand that in PAPILLON, there may be enforced battle zones or gameplay. If you disagree with enforced battles, please refrain from entering the game or game area. Your entry will be considered as your consent to this gameplay and acceptance of the corresponding consequences.
4.19 PAPILLON reserves the right to terminate its operation at its own discretion or in the event of termination of PAPILLON's operation for any other reason. PAPILLON will handle matters related to game termination operation in accordance with the relevant laws and regulations of the country regarding the termination of online games to protect the legitimate rights of users.
5.【Software License】
5.1 Using PAPILLON services may require downloading and installing related software. You can obtain this software directly from PAPILLON's official website or from third parties authorized by PAPILLON. If you obtain PAPILLON or a game with the same name as PAPILLON from unauthorized third parties, it will be considered as not having PAPILLON's authorization, and PAPILLON cannot guarantee the proper functioning of such games and is not responsible for any losses incurred as a result.
5.2 PAPILLON may develop different software versions for different terminal devices or operating systems, including but not limited to windows, iOS, Android, Windows Phone, Symbian, BlackBerry, Nintendo Switch, and other application versions. You should choose the appropriate version to download and install based on your specific situation. After downloading the installation program, you should follow the instructions provided to install it correctly.
5.3 If PAPILLON provides software, it grants you a personal, non-transferable, and non-exclusive license. You may only download, install, log in, and use this PAPILLON on a single terminal device for non-commercial purposes.
5.4 In order to provide a better and safer service, PAPILLON may recommend installing other software during software installation. You can choose to install it or not.
5.5 If you no longer need to use the software or need to install a new version, you can uninstall it by yourself. If you are willing to help PAPILLON improve its product and service, please inform us of the reason for uninstallation.
5.6 In order to ensure the security and consistency of PAPILLON services, PAPILLON has the right to update the software or change and limit certain functions and effects of the software.
5.7 After the release of a new version of the software, the old version may become unusable. PAPILLON does not guarantee the continued availability of the old version of the software and the corresponding customer service. Please check and download the latest version at any time.
6. User Code of Conduct
6.1 You fully understand and agree that you are responsible for all actions on your game account, including any content you post and the consequences thereof.
6.2 Except as provided in this agreement, you may not engage in any activities that infringe upon PAPILLON's intellectual property rights or harm PAPILLON or the legitimate rights and interests of third parties.
6.3 When using PAPILLON or PAPILLON services, you must comply with laws and regulations and may not engage in illegal or improper activities, including but not limited to the following:
(1) Violating the basic principles established by the Constitution;
(2) Endangering national unity, sovereignty, and territorial integrity;
(3) Leaking state secrets, endangering national security, or harming national honor and interests;
(4) Inciting ethnic hatred, ethnic discrimination, undermining ethnic unity, or infringing upon ethnic customs and habits;
(5) Promoting cults or superstitions;
(6) Spreading rumors, disrupting social order, and undermining social stability;
(7) Promoting obscenity, pornography, gambling, violence, or inciting crimes;
(8) Insulting or defaming others, violating their legal rights;
(9) Violating social morality;
(10) Engaging in other content prohibited by laws, regulations, or national provisions.
6.4 Unless permitted by law or authorized in writing by PAPILLON, you may not engage in the following actions:
(1) Deleting copyright information from game software and its copies;
(2) Reverse engineering, reverse assembly, reverse compilation, or any other attempts to discover the source code of the software;
(3) Scanning, probing, or testing game software to detect, discover, or locate any bugs or vulnerabilities;
(4) Copying, modifying, adding, deleting, attaching, running, or creating derivative works of data, data interactions between the client and server, and system data necessary for software operation stored in any terminal memory during software operation, using plugins, cheats, or third-party tools or services not legally authorized;
(5) Modifying or forging instructions, data in software operation, adding, deleting, changing the software's functionality or operation effect, or operating or disseminating software or methods used for these purposes, whether for commercial purposes or not;
(6) Using PAPILLON and PAPILLON services through third-party software, plugins, cheats, systems not developed or authorized by PAPILLON, or creating, distributing, or disseminating third-party software, plugins, cheats, or systems not developed or authorized by PAPILLON;
(7) Using, renting, lending, copying, modifying, linking, reproducing, publishing, establishing mirror sites for content in PAPILLON that PAPILLON holds intellectual property rights to;
(8) Establishing mirror sites related to PAPILLON or taking snapshots of webpages, or providing services identical or similar to PAPILLON services through methods such as setting up servers for others;
(9) Separating any part of PAPILLON for individual use or engaging in other uses contrary to this agreement;
(10) Using, modifying, or concealing PAPILLON's name, trademark, or other intellectual property;
(11) Engaging in any unauthorized actions not expressly authorized by PAPILLON.
6.5 If you engage in any of the following behaviors ("Illegal or Improper Behaviors") while using PAPILLON services, PAPILLON has the right to take one or more of the measures set out in the second paragraph of this section, depending on the severity of the circumstances, in accordance with this agreement and the relevant game rules, and may publicly announce the results of such measures:
(1) Implying or pretending to be an internal employee of PAPILLON or holding a special identity in any way, attempting to gain unfair advantages or affecting the rights of other users;
(2) Using or uploading illegal or inappropriate words, characters, or other content in PAPILLON, including for character names;
(3) Disrupting or affecting the normal operation of PAPILLON or PAPILLON services in any way, including but not limited to:
1) Violating or maliciously registering and logging into the game, including but not limited to maliciously registering game accounts in bulk and logging into the game in ways that disrupt server authentication, maliciously squeezing servers, etc.;
2) Maliciously engaging in activities that may cause game server crashes, delays, or disconnections for other players, such as using DDoS attacks on game servers or other players' network traffic, etc.;
3) Taking advantage of game bugs for personal gain, disrupting the game environment, or causing harm to other players;
4) Engaging in negative gaming that disrupts other users' gaming experience, including but not limited to maliciously hurting or killing teammates, forming malicious teams, maliciously losing points, negatively hanging up, running away, intentionally giving away kills, and other negative gaming behaviors;
5) Abnormal game data performance that affects PAPILLON's fairness, and other behaviors;
(4) Using various private servers, cheats, etc.;
(5) Using game synchronizers (including but not limited to using hardware synchronizers like keyboards and mice, to control multiple computers for gaming at the same time) and other hardware that can make you perform exceptionally in gaming efficiency or profit data (including but not limited to "clickers," etc., hereinafter referred to as "cheating hardware");
(6) Spreading illegal speech or inappropriate information;
(7) Stealing others' game accounts or game items;
(8) Engaging in game account trading, account sharing, etc., which affect account security;
(9) Without PAPILLON's permission, engaging in transactions with other users for game virtual currency, game equipment, game currency, and other game items, or obtaining game virtual currency, game equipment, game currency, and other game items or game services from third parties by purchasing, accepting as gifts, or other means;
(10) Recharging games or trading discounted game items through unauthorized discount channels (e.g., buying discounted skins through non-PAPILLON official channels) or entrusting third parties not authorized or recognized by PAPILLON to recharge games or using third-party software to recharge games without PAPILLON's authorization;
(11) Violating any provisions of this agreement or any provisions of national laws and regulations.
The measures set out in the preceding paragraph include but are not limited to:
(1) Warnings; and/or
(2) Muting, including but not limited to muting the entire game area, single area muting, and public channel muting; and/or
(3) Content reset, including but not limited to resetting or forcibly modifying illegal information or content you provide or upload, such as illegal nicknames, room names, images, etc.; and/or
(4) Reducing or restricting your game earnings, which include but are not limited to all data related to game character growth and leveling (such as experience, honor, reputation, titles, etc.), as well as obtaining virtual items such as items, equipment, and virtual currency in the game; and/or
(5) Deleting or canceling game accounts, game data, or other game-related information; and/or
(6) Restricting or prohibiting your entry into specific game scenes or the use of specific game functions; and/or
(7) Forcing you to exit the game (i.e., "kicking out of the game"), including but not limited to forcibly exiting the entire game, or a single game round, or other in-game behaviors you are engaged in; and/or
(8) Temporarily or permanently banning your game account from logging into PAPILLON (hereinafter referred to as "account suspension"); and/or
(9) Temporarily or permanently banning specific terminals involved in illegal or improper behaviors, including but not limited to PC terminals, mobile terminals, etc., from logging into PAPILLON; and/or
(10) Suspending or terminating your use of PAPILLON and related services, or unilaterally notifying you of the termination of this agreement; and/or
(11) Initiating civil litigation against your illegal or improper behaviors, pursuing your infringement, breach of contract, or other civil liabilities, and demanding that you compensate PAPILLON for the losses suffered as a result of your illegal or improper behaviors (including the direct economic losses suffered by PAPILLON, reputation or goodwill losses, compensation paid by PAPILLON to third parties, settlement costs, legal fees, litigation costs, and other indirect losses), or transferring the matter to relevant administrative authorities for administrative penalties, or transferring it to judicial authorities for criminal liability; and/or
(12) Other measures announced by PAPILLON through game rules (including but not limited to user guidelines, player rules, game announcements, tips, and notices).
You understand and agree that because cheats such as external programs and game synchronizers have the characteristics of concealment or disappearance after use, PAPILLON has the right to judge whether you have used illegal cheats such as external programs or game synchronizers based on your game data and abnormal performance.
6.6 You understand and agree that if PAPILLON takes account suspension measures against your game account in accordance with this agreement, the specific duration of the account suspension will be determined by PAPILLON based on the severity of your violation.
You understand and agree:
(1) During the account suspension period, your game virtual currency, game equipment, game currency, and other game items in your game account may not be usable;
(2) If the aforementioned game virtual currency, game equipment, game currency, and other game items have a certain validity period, that validity period may expire during the account suspension period, and after your game account is unlocked, you will not be able to use the expired game virtual currency, game equipment, game currency, and other game items.
7. Intellectual Property
7.1 PAPILLON is the intellectual property rights holder of PAPILLON. All copyrights, trademark rights, patent rights, trade secrets, and other legal rights and interests, as well as all information and content related to PAPILLON (including text, images, audio, video, graphics, interface design, layout, data, or electronic documents) are protected by the laws and regulations of the People's Republic of China and relevant international treaties. PAPILLON enjoys the aforementioned intellectual property rights and legal rights, except for the rights that other right holders should have according to the law. Without prior written consent from PAPILLON, you may not use PAPILLON (including all visual, audio, textual works, and other elements within PAPILLON, as well as the dynamic images presented by PAPILLON) for commercial purposes or transmit PAPILLON content over the Internet in any way.
7.2 If there is a platform or service on PAPILLON that allows you to create, produce, or upload content (referred to as "UGC platform"), concerning the content you create, produce, upload, or publish (referred to as "UGC content") using the UGC platform, you should ensure that it is legal and does not infringe upon the legitimate rights of others. You should also adhere to the relevant rules posted by PAPILLON on the UGC platform (referred to as "UGC platform rules"). You agree to:
(1) If the UGC content contains PAPILLON content (including but not limited to all visual, audio, textual works, and other elements within PAPILLON, as well as the dynamic images presented by PAPILLON) and/or other content for which PAPILLON holds intellectual property rights, you require written authorization and consent from PAPILLON for commercial use of UGC content. You must also comply with the relevant UGC platform rules.
(2) For UGC content, you irrevocably grant PAPILLON the right to use the UGC content in any manner (including but not limited to copying, distributing, renting, displaying, performing, broadcasting, modifying, adapting, disseminating through information networks, and other forms of use, both for commercial and non-commercial purposes, inside and outside this game, as well as inside and outside the UGC platform). You also authorize PAPILLON to sub-license or transfer the aforementioned usage rights to third parties. You undertake that PAPILLON's use of the content will not infringe upon any third-party intellectual property rights or other legal rights.
(3) For UGC content, you may only display it on PAPILLON and other platforms recognized by PAPILLON or use it in ways approved by PAPILLON. You may not, without PAPILLON's permission, distribute it on other platforms or authorize third parties for any publication, commercial profit, secondary derivative, or other usage. Violation of this will result in PAPILLON retaining its legal rights to prosecute.
(4) For UGC content, you irrevocably authorize PAPILLON, either on its own behalf or through professional third parties, to safeguard the legitimate rights of the content in case of infringement. Methods of safeguarding may include but are not limited to monitoring for infringements, sending cease-and-desist letters, initiating lawsuits or arbitration, mediation, settlement, etc. PAPILLON has the right to make decisions on safeguarding matters independently.
(5) If, according to copyright law and other legal provisions, you have the rights to disclosure, attribution, modification, and protection of the integrity of UGC content, you agree that PAPILLON can decide how to attribute and in what manner to attribute based on the specific use or use case of UGC content. You will not assert your rights to disclosure, attribution, modification, or protection of the integrity of the work due to PAPILLON's use of UGC content under this agreement.
7.3 Despite other provisions of this agreement, all ownership and intellectual property rights of game data generated while using PAPILLON services belong to PAPILLON, and PAPILLON has the right to retain and dispose of this game data. The retention period for user-purchased game virtual currency purchase records will comply with relevant national laws and regulations. The retention period for other game data will be determined by PAPILLON, except when national laws and regulations provide otherwise.
7.4 PAPILLON may involve third-party intellectual property, and if these third parties have requirements for your use of such intellectual property in PAPILLON under this agreement, PAPILLON will inform you of these requirements in an appropriate manner, and you must comply with them.
8. Compliance with Local Legal Regulations
8.1 You should comply with the relevant local laws and regulations while using PAPILLON services and respect the local morals and customs. If your actions violate local laws, regulations, or moral standards, you should independently bear responsibility for them.
8.2 You should avoid involving PAPILLON in political and public events through your use of PAPILLON services; otherwise, PAPILLON has the right to suspend or terminate your services.
9. Jurisdiction and Applicable Law
9.1 The place of signing of this Agreement is Hong Kong.
9.2 The establishment, effectiveness, performance, interpretation, and resolution of disputes of this Agreement shall be governed by the laws of Hong Kong (excluding conflict of laws).
9.3 In the event of any dispute or controversy arising from this Agreement between you and PAPILLON, you shall first attempt to resolve it amicably. If no amicable resolution is reached, you agree to submit the dispute or controversy to the jurisdiction of the people's court in the place where this Agreement is signed.
9.4 The headings of all terms in this Agreement are for convenience of reading only, have no practical meaning in themselves, and cannot be used as a basis for interpreting the meaning of this Agreement.
9.5 If any part of the terms of this Agreement is invalid for any reason, the remaining terms shall remain valid and binding on all parties.
10. Miscellaneous
10.1 PAPILLON reserves the right to change the terms of this Agreement when necessary. You can refer to the latest version of the terms on PAPILLON's relevant pages. If you continue to use PAPILLON services after the terms of the Agreement have been changed, it will be considered that you have accepted the modified agreement.
10.2 PAPILLON reminds you: Resist unwholesome games, reject pirated games; protect yourself and guard against being deceived; enjoy games in moderation as they benefit the mind, but excessive gaming harms the body; manage your time wisely and embrace a healthy life.
